The term APHRO EMAGE, or ‘us’ or ‘we’ or 'our' refers to the owner of the website ( @aphro-emage.co.za or Aphro-Emage Online )and owners of the brand Aphro Emage trading under Oracle Origins General Trades (PTY)LTD, whose registered office is at 504 Jozi House Suites, 29 Kerk Street, Johannesburg, 2000. Our company registration number 2015/ 203625 / 07, tax reference umber 9687421165 and place of registration Johannesburg, SOUTH AFRICA. The term ‘you’ or 'your' and or 'client/ customer' as well as purchaser, refers to the user or viewer of our website/ online store services.

Welcome to  Aphro Emage Clothing & Accessories online store. By accessing or using our website and online store http://www.aphro-emage.co.za , you agree to be bound by these Terms and Conditions. These terms apply to all visitors, users, and customers who purchase products from our store. If you disagree with any part of these terms, please do not use our services."This document and other documents that we reference below make up our house rules. Or what we officially call our terms of use (the T's).

TERMS OF USAGE 

@Apho-Emage is an online store, meaning we don't have walk-in store locations (until further notice). Our services offer none contact/ long distance sales. As an online clothing and accessories retailer we are open to service clients with the funds to make the purchase and supply the demand. But we keep an age restriction of 18 years and older as per legal age in South Africa. We also reserved the right to not engage with or respond to disrespectful, derogatory, bullying, belittling, prejudice or racist behaviour and dialogue or language. We expect all interactions, dialogue and communication to be of a professional and respectful manner. These details may not be requested or specified when making a purchase, but we have clearly stated them here in the terms. Payment made as purchases are handled with the understanding that the terms have been consulted and the purchaser is of age and has authority over their spending. We may not be held liable for any dispute on funds spent on the online store.  

Our product is despatched from a storage facility using the details exchanged between you (the purchaser) and the @aphro-emage.co.za order system that will capture the details that "you" enter. "Your" email address, "your" contact/ phone number and "your"  address. It is thus "your" responsibility to ensure that "you" provide/ capture the correct information to allow us to make the necessary arrangements and contact you should we need to. Failure to provide "us" with accurate details on placing an order automatically marks the order as voided. All shipping/ postage costs purchase of order or return of products will be carried by "you" the purchaser. 

"You" acknowledge that Aphro-emage Online will use the email address and information "you" provide on opening an order/ processing an order, and use it from time to time as the primary method for communication and marketing. As part of "our" marketing and customer contact, @aphro-emage.co.za may also use the phone number "cell" to text "you" as means of WhatsApp marketing.

"We" outsource "our" postage/ shipping responsibilities to reputable, trusted and affordable courier service providers. Courier service providers such as PAXI by Pep store, ARAMEX by PnP and PostNet postage. As reliable as these services provides may be. There may be unforeseen circumstances that may cause a delay in delivery or damage to the parcel and in some cases the merchandise. In such cases we would not be held liable for any damages or inconvenience caused.

Our online regulations are guided by the Electronic Communication and Transactions (ECT) Act and also the Customer Protection Act (CPA).

RETURNS POLICY (T'c&C's)

• All exchanges, returns and refund queries are to be directed to [email protected] please.
• Give aways and complimentary items may not be returned or exchanged.
• Purchased items may be returned if found unsuitable, faulty  or unwanted.
• Purchased items need to be returned within 14 days of receipt/delivery.
• Purchased items may be returned only if they have not been used. Items must be in original condition, packaging and all swing tags still attached. ( so keep the packaging boxes included, if not sure )
• Original invoice maybe requested on request to return purchase ( to verify purchase time frame, please save emailed invoice ) "order email  verification also allowed".
• Return of goods shipping/ postage cost will be carried by the customer ( you as the returner )
• Goods found to be worn up on inspection will not be refunded or exchanged (claws 5 of returns policy violation ). Clients will be notified by email or text.
• Refunds on deposit/ transfer will  take 7 up to 15 working days to clear. ( Please be patient and understanding there are background checks and clearances that must be followed for  security reasons ). Thank you in advance.
• Refunds on Card takes 7 up to 30 working days to clear back to clients account.( Please be patient and understanding there are background checks and clearances that must be followed for  security reasons ). Thank you in advance. 

Intellectual Property

The Copyright Act provides intellectual property rights to original literary, artistic, musical, and other creative works.  Copyright protection is automatic and does not require registration.  Copyright holders have the exclusive right to reproduce, publish, perform, display, and distribute their works.

Aphro Emage owns all intellectual property rights in the website and in the material, images and information published on it. These works are protected by copyright laws worldwide. Permission is granted temporarily to download one copy of the materials images  or information from the Aphro Emage website for personal, noncommercial transitory viewing only. This is the grant of a licence, not a transfer of title, and under this license you may not: modify or copy the materials, images and information or use the materials, images and information for commercial purpose, or any public display (commercial or non-commercial).
Attempt to decompile or reverse engineer any materials, images or information on the APHRO EMAGE web site; or remove any copyrights or other proprietary notations from the materials, images and information; or transfer the materials, images and information to another person or "mirror" the materials, images or information on any other server. This license shall automatically terminate if you violate any of these restrictions and maybe terminate by APHRO EMAGE at anytime. Upon terminating your viewing of these materials, images and information or upon termination of the licence. You must destroy any downloaded materials, images and information in your position whether in electronic or printed format.

WARRANTIES AND LIMITATIONS OF LIABILITY

Despite our best efforts, a small number of the items in our catalogue may be mispriced. We reserved the right to verify all pricing when processing your order and before we take payment. If we have made a mistake and a product's correct price is higher than the price on the website, we reserved the options to either contact you before dispatch to request whether you want to buy the product at the correct price or cancel your order. Or decline purchases at a mispriced rate. If a product correct price is lower than our stated price, we will charge the lower amount plus shipping and send you the product.
